These Website Terms of Service (“Terms”) govern access to and use of the POV Analytics website located at povanalytics.net (the “Website”), which is operated by POV Analytics LLC (“POV Analytics,” “we,” “us,” or “our”).

By accessing or using the Website, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, you should not use the Website.

1. Website Purpose

The Website provides information about POV Analytics, its services, methodologies, areas of expertise, educational materials, articles, and related business information.

The Website is provided for general informational and business purposes. Information presented on the Website should not be interpreted as a guarantee of any particular business, marketing, search-engine, artificial-intelligence, traffic, conversion, revenue, or other result.

Use of POV Analytics services by a client is governed by separate contractual agreements, including, where applicable, a Master Services Agreement, Statement of Work, Website & Data Access Authorization, or other written agreement between the parties.

These Terms do not themselves create a client relationship, engagement, partnership, joint venture, agency relationship, or obligation for POV Analytics to provide services.

2. Permitted Use

Visitors may access, browse, read, and use the publicly available content of the Website for lawful personal, informational, or legitimate business purposes.

Visitors may not use the Website or its content to:

• Violate applicable law or regulation;
• Attempt to gain unauthorized access to the Website, its systems, or related infrastructure;

5. Free Audit Requests

The Website may contain a “Free Audit” feature that assists a visitor in preparing an email requesting a potential audit or related discussion.

The Free Audit feature does not constitute an online submission portal, account system, application, or service agreement. Selecting the Free Audit feature may open a visitor's email application with a prepared email addressed to POV Analytics. The visitor remains responsible for reviewing and sending the email.

Submitting or sending a Free Audit request:

• Does not create a client relationship;
• Does not guarantee that POV Analytics will perform an audit;
• Does not guarantee that POV Analytics will respond;
• Does not guarantee that POV Analytics will provide services;
• Does not guarantee that the visitor will be offered an engagement;
• Does not guarantee any particular findings, recommendations, results, or business outcomes; and
• Does not obligate POV Analytics to enter into a service agreement.

POV Analytics may determine, in its sole discretion, whether and how to respond to a Free Audit request and whether to offer services to a requesting party.

Any services offered by POV Analytics will be subject to separate written agreement and applicable terms.

6. No Guarantee of Results

POV Analytics does not guarantee or warrant any particular outcome from the information, strategies, recommendations, services, or materials described on the Website.

Without limitation, POV Analytics does not guarantee:

• Search-engine rankings;
• Search-engine indexing;
• Organic traffic;
• Search visibility;
• AI-generated answers or responses;
• AI citations or recommendations;
• AI referrals or visibility;
• Website traffic;
• Conversion rates;
• Leads;
• Sales;
• Revenue;
• Customer acquisition;
• Return on investment;
• Inclusion in search features or AI-generated results; or
• Any other specific business, marketing, search, or financial result.

Search engines, artificial-intelligence systems, advertising platforms, analytics providers, hosting providers, website platforms, and other third parties operate independently of POV Analytics and may change their systems, algorithms, policies, functionality, availability, or requirements at any time.

Any services provided to a client are additionally subject to the disclaimers and limitations contained in the applicable client agreement.

The Website may reference, rely upon, or contain information concerning third-party services, platforms, technologies, or providers, including but not limited to Google, Google Search, Google Analytics, Google Search Console, Cloudflare, and other technology or marketing platforms.

POV Analytics does not control third-party services and does not guarantee their accuracy, availability, security, functionality, policies, pricing, performance, or continued operation.

Third-party services may change or discontinue functionality without notice. POV Analytics is not responsible for changes, interruptions, errors, security incidents, outages, or other events arising from third-party services except to the extent otherwise required by applicable law.

A reference to or use of a third-party service does not necessarily constitute an endorsement, sponsorship, partnership, or affiliation.

8. Website Availability and Accuracy

To the maximum extent permitted by applicable law, POV Analytics LLC and its owners, representatives, contractors, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to use of, or inability to use, the Website or its content.

This includes, without limitation, losses arising from business interruption, lost profits, lost revenue, lost opportunities, loss of data, reliance on Website content, third-party services, website availability, or technical failures.

Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by applicable law.

Where a separate written client agreement exists between POV Analytics and a client, that agreement controls the parties' contractual relationship and applicable limitations of liability.

14. Indemnification

To the maximum extent permitted by applicable law, a visitor agrees to indemnify and hold harmless POV Analytics LLC and its owners, representatives, contractors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from the visitor's unlawful use of the Website, violation of these Terms, or infringement of another party's rights.

Nothing in this Section requires indemnification to the extent prohibited by applicable law.

These Terms do not replace or modify a separate written agreement between POV Analytics and a client. Where a client has entered into a separate written agreement with POV Analytics, that agreement governs the applicable client relationship.
